Shaaniu had recently opened a fitness centre and was still trying to improve his stock of fitness machines. He knew that his friend, Khaleel is a mechanic , Shaaniu agreed with Khaleel that Khaleel would service all the machines for an annual fee of MVR12,000. The written contract stated that Khaleel would service and repair any machine within 48 hours of being requested to do so, or would supply a replacement. During the first three months, Khaleel twice took 55 hours to return machines and did not supply a replacement on either occasion. Shaaniu terminated the contract with Khaleel and demanded the return of the MVR12,000 fee.
