Shammy and Yoe used to be best friends. However, they have fallen out of friendship when Yoe started to court Shammy's only sister, Yanna. Shammy prohibited Yanna from seeing Yoe. Yoe asked for Shammy's explanation for his disapproval of Yoe-Yanna courtship. During a heated argument, Yoe punched Shammy's face.

Shammy was so angry with Yoe's act in punching his face. Shammy wanted to seek vengeance upon Yoe. Shammy engaged Asif, a local thug, to illegally enter Yoe's house and ransacked his personal valuable belongings. Asif was also told to punch Yoe's face as well. Shammy agreed to indemnify Asif against all consequences of the acts. Asif carried out the acts that he was engaged to perform. Yoe successfully sued Asif for damages amounting to RM100,000 which Asif promptly paid. Asif, considering himself as Shammy's agent, wanted to recover from Shammy the RM100,000 and the legal expenses incurred in defending the suit.

Advise Asif whether he may succeed in claiming indemnity from Shammy.
