Shapp's Shake Shack ("the Shake Shack") has an extremely secretive recipe for cooking burgers in its restaurant. The Shake Shack considers this recipe a trade secret, as that is one of the reasons it is in business. Ten years after the Shake Shack opens, Raffy's Burger Joint starts using the same recipe, which it formulated independently of Shapp's Shake Shack. The owners of Shapp's Shake Shack sue the owners of Raffy's Burger Joint for infringement on the intellectual property. Who will win the law suit and why?
