Should the Government be regulating, banning or taxing sugary beverages such as Big Gulps? What has been the consumer experience in cases involving cigarettes and other tobacco products including e cigarettes? What about warning labels? Does assumption of the risk apply here? I remember growing up in the fifties when we referred to cigarettes as "cancer sticks". Similarly what about alcoholic beverages? Should there be more extensive warning labels? Should there be strict liability? Is drinking an ultrahazardous activity? Should assumption of the risk apply?
