Sid's Market Sid's Market is an upscale supermarket that caters to a clientele living Toronto. Although most of the supermarkets in Toronto are unionized, Sid's market has been able to avoid unions by matching unionized markets' pay and benefits. Sid Clark, founder and owner of Sid's, has told store manager Lisa Shaw that one of her top priorities should be discouraging union organization at the market. Clark is convinced that if the store is unionized, it will lose its "family" environment and become a bureaucratic, impersonal market like the other major food chains in Toronto. Recently, Lisa became aware that the United Food and Commercial Workers (UFCW) union is attempting to organize Sid's market. In trying to discourage the UFCW, she took the following actions to implement Sid's union avoidance strategy: Several employees privately told Lisa they did not support the union, and she informally gave them more desirable shifts. Lisa told employees they could come to her with any questions or concerns. One day later, an employee asked Lisa whether she supported the union. She responded "my personal belief is that we have a family environment here, and the company works really hard to resolve employee issues and listen to concerns. I do not feel a union would improve things". Two days later, an employee said they can't imagine a union causing much harm. Lisa responded "my personal belief is that we have remained competitive because we're different than other grocery stores. If we unionize, we'll lose a lot of what makes us unique and we'll be like every other store in Toronto. And as you know, some of our competitors were doing good business but had to close. Part of the reason was these stores had to raise prices to meet union demands". Three days later, an employee said the union wouldn't impact them much. Lisa responded "well, remember, dues will be deducted from your pay. And the collective agreement will determine how we operate around here. Right now, I make decisions by talking to you and deciding what's best for everyone. A collective agreement can make things more formal". Lisa contacted a union known to be quite employer-friendly, and invited them to speak to employees during the mandatory monthly staff meeting. Lisa helped organize the annual "Sid's Market Picnic", which is held every year on August 1. A few weeks after these incidents, Shaw received a letter from the Ontario Labor Relations Board indicating that the UFCW had accused Sid's market of engaging in unfair labor practices designed to prevent employees from forming a union.
