Simon, a professional bodybuilder, was working out in his home gym, when his barbell bent. Simon went to his local sporting-goods store and told the clerk what had happened with the barbell. The clerk recommended that Simon purchase a particular barbell that would meet his weight requirements and should not bend. Simon purchased that new barbell.

On the drive home, Simon went through the drive-thru at a Smoothie Joint and purchased a health drink. This was his usual drink, but it tasted differently. By the time he got home, Simon was extremely ill from the smoothie. He had to be hospitalized and it was determined that the smoothie had a chemical substance in it. Eventually Simon recovered and started working out again at home. When he attached the weights to the new barbell and started his workout, the bar snapped in the middle and severely cut him.

Does Simon have any possible lawsuits here? Who can he sue? How successful do you think he would be? What warranties are involved here?
