Simon and Trudy have a son Frodo who is 9 years old. Simon and Frodo are both keen gamers and they frequently log onto their tablet device in search of the latest games available. They have come across a new game called the "Home Builder". The game was developed by an Australian company based in Fortitude Valley, Brisbane. In order to win in the "Home Builder" game, one has to build the most attractive looking house in the app in the quickest possible time. The app allows each participant to upgrade the home building tools with the use of Home Builder currency ("HB currency). The more expensive the home building tools, the faster the home can be built and the more outstanding it will be. HB currency can be purchased through the use of a credit card. Prior to the purchase of any HB currency, the competitor will need to tick "Accept" on the terms and conditions in the app before proceeding further. Part of the terms and conditions contains the following clause in small print:- "The purchaser agrees that he/she is of legal age and is capable of making an informed decision on any purchase made through this app. As such no refunds will be made for any change of mind or for any other reason whatsoever". Without his parents' knowledge and consent, Frodo ticks "Accept" on the terms and conditions and uses his father's credit card to make a $1.000 purchase worth of HB currency. Frodo was keen to upgrade his home building tools in the "Home Builder" game so that he could increase his chances of winning in the game. Simon and Trudy have just discovered this and are now seeking your advice. REQUIRED Advise Simon and Trudy in contract law if they can get their $1,000 refunded. [15 marks)
