Some people have had a difficult time deciding whether hate crime laws are constitutional . Some of the strongest arguments against hate crime laws have focused on the First Amendment's protections of speech and association, and the argument that hate crime laws penalize what individuals want to say and think and whatever group affiliations that an individual desires. Furthermore, several critics have argued that speech or expression, even if 'offensive', is not a crime. One of the main opposing views to this argument is that although thought and expression are protected by the First Amendment, illegal conduct is not; and this is one of the main reasons for the enhanced criminal sentence if it can be determined that a crime was committed with a racist anumus or discriminatory grounds
