Sonya is a reputable businesswoman who is in the business of real estate. She obtained

various business loans from the Maya Bank in Malaysia to finance her business expansion

overseas in China. She has estimated that her expansion would be complete by the year 2022

and her business would be able to generate a substantial amount of profits. In year 2020, the

COVID-19 pandemic hits and the real estate market has slowed down immensely. Sonya's

business suffered from a critical blow to its cash flow, and she was unable to pay her debt to

Maya Bank, totalling up to RM 400 million. After a restructuring negotiation, the bank has

agreed to reduce the amount of interest and Sonya would be liable to pay RM 323 million as a

net outstanding balance. Sonya's business sales have recovered in year 2021, setting record

profits. Maya Bank now sought to terminate the restructuring agreement, seeking for Sonya to

pay the original RM 400 million arguing that such benefit was given to her based on their

belief that Sonya would continue to suffer from financial difficulties in 2021.
