Specific performance says that you have the manufacturer do what they were supposed to do but do we really want NGT to keep doing business with a company that, at the end of the day, is just incompetent? Wouldn't it be better to pursue damages to make NGT whole and, in doing so, tie up the manufacturer's assets so that there is property available to levy and sell if we get to the point of obtaining a judgment?
