He sometimes took her to networking functions where she mixed and mingled with potential clients and talked up her boss. Stacey had taken some online courses in accounting and in her spare time, she has been studying the books to see how she can make the numbers look better. She inflated some billings and expensed some of Larry's personal bills through the firm accounts. Larry and Stacey began attending more functions to meet new potential clients. Stacey finds herself drinking and hobnobbing harder than ever before, sometimes staying on at the events even after Larry has left. One raw, rainy evening just before Christmas, after several drinks, Stacey found herself one of the last to leave a party at the golf club. As she was getting her coat, she found herself in the empty cloakroom where Brian, one of the potential clients she was talking to during the evening, told her that she looked ravishing and offered to help her with her coat. What transpired afterward would be described as inappropriate touching and some kissing. Stacey broke loose and ran to her car. Fumbling for her keys, she did not realize that she had dropped her smartphone in the parking lot. Let's discuss this case from a general overview: Stacey was wrong in committing the offense of manipulating the accounts of Larry's, for which she can be sued by Larry on the charges of infringement and misrepresentation of account's number on the claim that she did an intentional tort of negligence that caused a monetary damage to company's property Moreover, Meghan can't claim to recover the damage and damages caused to her and her son but here, because here Meghan owes the duty of care towards her son and Stacey was already passed out when Meaghan' car got hit so it was beyond the foreseeability and control of Stacey. However, this is not the point of focus. This case revolves around Stacey and Brian. Stacey has been found the victim of "Inappropriate touching and kissing" done against her will by Brian, as a result of which Stacey was placed under condition and urge of drink and drive, but here the fact that she was driving, the car with expired license can't be ignored as it is stated in the given case that she was getting ready to leave the party that implies she drove the same car to reach the party and was Negligent in fulfilling her responsibility of renewing her contract with insurance company. Thus, she is responsible for the loss or damage occurred to the property (Guardrail) as a result the accident occurred. But considering Stacey the victim she in a position to file a sue against Brian for the offense of "Sexual Harassment" and its consequence effect on Stacey's car accident also can sue him for the "Tort of invasion of privacy" as his act of posting some personal, confidential, and proprietary information of Larry's clients from the Stacey's smartphone on his website fulfils the elements of 'Invasion of Privacy, i.e. Reckless Intentional conduct, invasion of plaintiff's private affair without lawful justification and caused humiliation and Distress to Stacey and Larry's company.
