Statement of Facts

1. Laucala Company Limited ("LCL") is a development company based in Suva and it owns 2 acres of land at Ba Town.LCL wants to construct a new mall on the land where a derelict building sits. The derelict building must be removed before LCL can start the development work. The Director of Town and Country Planning has provisionally approved a Town Planning Scheme for Ba town which has a provision designating a 1 acre part of the land as a public park for the people of Ba. The time for objection to the provisionally approved scheme has not expired.
