Statute Paper

Title of Statute, including whether it is national, state or local

I. Introduction.

Identify the statute and why you think it is important in a business context. Be sure to relate the case to a business topic, i.e. don't just pick a statute because you think it is interesting or politically important (Act 10is a very interesting statute, but not a good example for a business law paper unless you intend to talk about public sector unions in general). You should include a history of the statute if known.

II. The Statute Itself.

Explain the language and the meaning of the statute.Quoting the language of the statute is fine, but provide something more than a simple quote. Explain the definitions of terms used in the statute and the way the statute fits into the larger business environment.

III. Interpretation.

Explain how the statute has been interpreted or applied.You can use an existing case or make up a hypothetical situation to which the statute would apply. Give sufficient facts to explain the situation and then analyze how the statute would apply to the facts you have created.Explain how the statute would influence the business decision-making for people or companies to which it applies.

IV. Conclusion and Analysis.

Explain your analysis of the statute. Is it working the way it should work? Is it creating more problems than it solves?Is it meeting the public policy that it was designed to address? What would you change? This is the most important part of the paper. Be sure that your analysis demonstrates that you understand the statute and how it fits into the bigger picture of the business community.
