Steve was a paralegal working for his supervising attorney, Kathy, who had been an attorney for 20 years. Kathy was a family law attorney and had only practiced family law.

Steve's next-door neighbor, Bob. was very upset with Steve's gardener because according to Bob, Steve's gardener was always blowing Steve's trash into Bob's yard. Steve and Bob shared a front lawn without a dividing fence. When Bob was done complaining about Steve's gardener, Steve suggested Bob to sue his gardener (the Gardener). When Bob asked Steve about his chance of winning the lawsuit, Steve replied, "I work with an attorney in a law office but I am not a lawyer. 1 just get along and work with one. I am sure you have at least 55% of winning but what do I know, my law firm where I work does only family law." Steve also said, "My attorney is pretty good because she has 20 years of legal experience." Bob wanted to see Steve's attorney, Steve told Bob to go into this law office the next day and he will arrange a meeting with his attorney.' Kathy was not in the office the next day, so Bob talked to Steve in the law office. Steve arranged a retainer agreement with a contingent fee structure. When Kathy returned to the office, Kathy told Steve she did not know much about this type of lawsuit because she had been a family law attorney all her career. Steve told Kathy not to worry because he had done a lot of similar cases in his previous law firm and that if there was anything Kathy needed to know, Kathy could always ask him. Kathy replied, 'Okay, I guess you are on your own in this case."

A week later, Steve's Gardener ran into Steve in a fit of rage and told Steve. Can you believe Bob is suing me?!!! The Gardener continued, "I am mad as hell and I want to run my truck into Bob's stupid car and I want to hurt him! The Gardner also yelled, "I got my own attorney now!" Steve told his gardener, Calm down, Bob's attorney always leave trash and office documents in a blue trash bag on trash pick up day." Chuck continued. "Maybe you can go check out that blue trash bag and maybe you can find something useful for your case." Next day. Check told Kathy not to put this week's trash out and be on a look out for the Gardener. Steve told Kathy that the Gardener looked very mad and had retained his own attorney! Back on the job. Chuck drafted a letter for Bob to the Gardener. The letter asked the Gardener to pay Bob $500 as a way to settle this potential lawsuit. Before sending out the letter Steve asked Kathy to look at it Kathy told Steve, "l'm busy. Read it to me." Steve read the letter and on the 4th sentence (the letter is two pages in length) Kathy answered her cell phone. Covering her phone. Kathy whispered, "Letter sounds good. I have to take this call. I'll talk to you later" Steve left Kathy and mailed out the letter to the Gardener directly.
