Stevie owns and runs a full-service hairdressing salon calledHair by Steviein Cambridge, Tasmania, near to her home in Richmond. Stevie engages the services of Rose's Plumbing to replace the water pipes that run into the shop, and to change the fittings that she uses with the hair-wash basins. The job is to be done over the weekend from Saturday afternoon through Sunday when the shop is closed to customers. Having signed the contract and confident in Rose's Plumbing expertise, Stevie leaves her salon at noon on Saturday to join friends in Hobart for a movie and dinner.

Rose's Plumbing does not start the work on Saturday. Instead, believing it is a small job, the plumbers arrive late on Sunday.

Things go wrong immediately for the plumbers. One of the workers punctures a main pipe and the shop is flooded with water, and water seeps through either side of the shop into the premises of the neighbouring businesses. The damage is significant, and considerable work is now needed to repair Stevie's salon, as well as the neighbouring businesses.

Stevie has accrued some $80,000 damages to her shop. She loses two days of business (approximately $1000) before she can 'borrow' space at a friend's hairdressing salon while the repairs take place. Stevie is also concerned that she will lose customers, and that this will affect the reputation of her business.

Stevie is obviously upset, and wants compensation from Rose's Plumbing, which she knows has insurance.
