Students MUST use the IRAC method (Issue, Rules, Application, Conclusion) to answer the following scenario. All answers MUST be supported with relevant statute or case law authority.
Scarlett enters into a contract with a local proprietor Andrew who has a business "Andrew's happy house of cats". There are currently over 100 cats boarding with Andrew.
Scarlett, or a contractor of Scarlett's, will visit the Andrew's house every Thursday and 5 cats will be groomed (Andrew is not home then as he is out teaching law.
Scarlett contracts an expert groomer and cat whisperer named James who talks and sits with the cats as he cleans and grooms them. He is to start to 15 September for a period of 3 months.
Just before he is about to start work with Scarlett, Jade, an owner of a local cat caf, hears about James and tells him to break his contract with Scarlett and work for her.
Students MUST use the IRAC method (Issue, Rules, Application, Conclusion) to answer part (a):
a) Advise Scarlett what actions she has against James available to her in contract law. (6 marks)
b) Does Scarlett have an action against Jade? (Please disregard the tort Scarlett has available against Jade for damages for inducing the breach of contract) (1 Mark)
