Question: Mary agreed to transfer her land to Damia as security for a loan sum of RM15,000 to be advancedt o her by Damia. Subsequently, on 3 September 2011 they executed a memorandum of transfer and the money amounting to RM15,000 was handed over to Mary. Simultaneously they executed an agreement where Mary will repurchase the land within three years from the date of the agreement. On 1 September 2014, Mary approached Damia to pay the full loan amount and to obtain the transfer of the above mentioned land. Unfortunately Damia refused to accept the payment unless Mary agrees to pay an additional sum of RM1,000 being payment for service charge. Advise Mary whether she is entitled to redeem the land as provided under the agreement.
