Describe FOUR (4) legal principles relating to Annual Leave. ( 4 marks) 3. List the requirements that a female employee must fulfill to get paid maternity leave. ( 2 marks)SECTION B: SCENARIO BASED QUESTION 1. Joseph recently joined HartaBina Berhad as Sales Promotor with a salary of RM1890 and was put on a three months' probation from May to August 2022 . On 23" May 2022, he tested positive for Covid 19 after a company event and was put under a Home Surveillance Order for five days. He was surprised to discover that his salary was deducted for five days at the end of the month because the company claimed that a probationer is not entitled to paid sick leave. On 6" June 2022 which was a public holiday in Malaysia, Joseph and the whole Sales team was required to attend an important event. When Joseph asked his manager whether they will be getting any additional pay for working on a public holiday, the manager states that employers can choose any public holiday that they want to observe and HartaBina did not choose the Agong's Birthday as a public holiday, so 6" June is counted as a normal working day. Based on the scenario above and the Malaysia employment law, answer the following questions: a. Explain to Joseph whether HartaBina's claim that a probationer is not entitled to paid sick leave is legally correct. (3 Marks) b. Is the company right in not choosing Agong's birthday as a public holiday to observe? (3 Marks) 2. Abby, an account clerk earns RM1600 per month. In September 2022, she took 3 days unpaid leave for personal reason and the leave was approved by the company. When she came back from the leave, many tasks were pending so her supervisor asked her to do overtime to ensure that all back logs can be cleared as soon as possible. She did a total of 6 hours overtime on Tuesday, Wednesday and Thursday which are her normal working days. On 16" September 2022, Abby was asked to come to work for an urgent matter. She clocked in at 8.30am (which is her normal time) and clocked out at 4.30pm, one hour earlier than normal but with approval from her supervisor. Based on the above, calculate the amount of salary that Abby will get for September 2022. ( 9 Marks)
