Sukhi has recently moved into an apartment building near Humber College which she is attending. It is a nice, quiet apartment building conveniently located on a bus route. She signed the lease which had a provision that no pets would be allowed. Sukhi was not concerned about this clause as her dog stayed with her parents and she had no intention of having a pet while she is studying at Humber.

Recently, her good friend Lucy received a great job offer overseas. It has always been Lucy's dream to travel and work abroad so she was excited to accept the position. Unfortunately, taking her two cats with her was not an option.

Sukhi is an animal lover and has known Lucy's cats for several years. She could not stand the thought of the cats being in a shelter and not knowing what would happen to them so she took them in.

Several tenants have complained to the landlord that Sukhi is keeping cats which the building does not allow. The cats are well behaved and not very noisy but a couple of the tenants have complained that their allergies are acting up as air travels through the ducts and they have cat allergies.

Sukhi would like to know if there is any way she can stay in her apartment with the cats.

A. What is the relevant statutory provision that deals with this fact scenario?

B. Find 3 relevant cases, briefly describe each case and how it applies to this scenario.

C. what advice would you give to Sukhi?
