Negligence can happen with accounts, doctors, hospitals, and service providers when their behavior fails to meet accepted standards. Negligence Has five basic elements, one of them being due care. "People are required to exercise due care and caution for the safety of others when risk of injury to another is present. Failure to do so is negligence" (Morgan, 2019). Some injuries are recognized as unavoidable accidents when it's determined if the person used proper due care and caution. Examples of due care can be a sunbather warning swimmers that there are sharks in the water. A driver would need to be in a safe behavior such as following speed limit or no texting while driving, to prevent car accident.
Negligence by Professional Persons: Malpractice
There have been numerous suits of negligence in malpractice, by patients and clients against professionals. Malpractice suits occurs when doctors fail to comply the degree of care and caution that's required. Suits against doctors and hospitals have multiplied that the cost of their malpractice insurance have been affected as well. Doctors have been practicing defensive medicine due to the increasingly large number of malpractice suits. For example, most doctors prescribe tests that are not needed, requiring longer hospital stays, and doctor consultations as a routine.
