Sunil is a tenant living in one of the units of a duplex owned by Loretta. Sunil is recently divorced and has four-year-old twins who live with him every other weekend. Sunil tells you that since he moved in a few months ago, his toilet has not been flushing properly and that he finally asked Loretta to fix it a few weeks ago. When Sunil arrived home with the twins shortly after noon the following Saturday, he unexpectedly found Loretta in his unit, together with a plumber who was there to fix the toilet. The twins were fighting with each other and behaving badly. The plumber took the toilet apart and found a small pill bottle wedged inside, which was the cause of the problem. As the plumber was leaving, Sunil heard Loretta say to him: "I didn't know about these kids when he rented the apartment. I'm going to have to do something about it!" A few days later Sunil received a notice from Loretta that his tenancy was being terminated because he caused damage in the rental unit. The notice said that Loretta could evict him unless he paid her the cost of fixing the toilet. Sunil called Loretta to talk to her about the notice. He told her that he did not cause the damage to the toilet. He said that the toilet had never flushed properly and the damage must have therefore been caused by the previous tenant. Loretta responded by accusing one of the twins of flushing the cap down the toilet and hung up the phone. She said that if he didn't pay her by the end of the day, she was going to change the locks on his rental unit. Sunil was so worried about being evicted that he decided to pay Loretta the cost of repairing the toilet. He did, however, withhold that amount from his next rental payment.
