Superior Court Awards $4M to Blind Man: John Bruce Was Shot in Head at Days Inn in 02. From: The News-Sentinel (Fort Wayne, Ind.) Date: 9/1/2007 Sep. 1--A few million dollars won't bring back a Missouri man's eyesight. John Bruce, blinded after a gunman shot him in the head during an armed robbery at a Days Inn in Fort Wayne in 2002, was awarded $4 million in damages by an Allen County Superior Court jury on Thursday. The jury also awarded the man $100,000 in punitive damages. Half the money and the punitive damages are to be paid by Fort Wayne Innkeepers Inc., owner of the Days Inn at the time of the robbery. The lawsuit claimed the hotel did not ensure the safety of its guests or provide proper security. It also said management should have foreseen such issues based on previous crimes at the motel. The other half is to come from four people convicted of being involved in the robbery, though each was sentenced to lengthy prison terms in 2005. The shooter, Jajuan Burley, was sentenced to two consecutive 20-year prison sentences. Three accomplices have been sentenced to 16-20 years in prison. Bruce had been in Fort Wayne at the time of the robbery to pursue a truck-driving career. He was a guest at the motel when three of the robbers came in demanding money, while a getaway driver waited outside. They beat up a female clerk and as Bruce crouched down in the lobby, one of them shot him in the temple. Bruce testified in the trial that the bullet cost him his eyes as well as his sense of taste and smell. Bruce's attorney, Charlie Davis, said he expects lawyers for Fort Wayne Innkeepers to appeal the decision and didn't know when Bruce would get any money from the company. "It's already been five years; I don't know how much longer he'll have to wait." Questions 1. What kind of case is it? Criminal Civil 2. What kind of case is it? State Federal 3.
