Question 1

Lisa is an English teacher in Star International School. She is popular among the students for

her innovative way of teaching English. One day Lisa decides to play a game of musical chair

with her students. Chairs were arranged in a circle and students who could not get a seat when

the music stops must recite a short poem in English to the whole class. Afiq, a shy and quiet

student feels extremely nervous at the prospect of talking in front of the class and thus tries very

hard to win at every round. As the game progresses, the chairs get fewer, and more students

were penalized. During one particular round, Afiq anxiously circles the chairs and when the

music stops, he literally jumps on a chair to get a seat. Unfortunately for Afiq, one of the chair's

legs breaks and Afiq stumbles to the ground, breaking his arm in the process.

Afiq wishes to sue Lisa under negligence. He knew that Lisa owes him a duty of care as a

teacher but want to know whether Lisa has breached her duty. Based on your knowledge on

negligence principles, discuss whether Lisa has indeed breached her duty.
