The common driveway extended 5 feet into each property. Both contributed money and labor to the effort. For the last ten years both regularly have used the common driveway. Six months ago Susan sold her property to Peter. Peter commissioned a survey of the land and discovered that the common driveway engrossed 5 feet into his property. If Peter places a chain link fence down the middle of the common driveway, but on Peters side of the boundary line and Eddie sues to have it removed who will likely prevail?
