He has been in business as a sole proprietor on the same street corner, in the same small town for twenty (20) years. He has ve (5) part-time employees. The town has gotten an injunction allowing them to raze the city block where his business is located in order to put in a parking lot. Ben is contemplating ling suit for disparate treatment alleging that he is being against due to his race which is a minority for the overall make-up of the town. Moreover, Ben believes that the Mayor has been spreading malicious lies against him in order to hurt his business. Ben is arguing that he will have to close up as he can not afford the rent in other areas of the townand that he serves a need for town and should therefore be allowed to stay in business
