The Army issues a solicitation for the rental of 25 rock barges that will operate in all waters, both coastal and inland and will be required to operate 7 days per week, 24 hours per day. Dimensions were expressed as not exceeding 130' in length; 35' in width and 8' in loaded draft. Among other things, the specification required that 'the barges must be at least 400 DWT capacity.' [DWT or "deadweight tonnage" is a measure of how much weight ship is can safely carry.] The contract provided for an inspection of the barges prior to acceptance for use, and preparation of a report of joint inspection. Appellant agreed to maintain the barges in good operating condition and in accordance with the 'standards and specifications of this contract at all times during the contract period.' The contracting officer also retained the right to inspect barges for compliance with said standards and specifications at any time during the contract period.
