Plaintiff Jesse Thompson, the only African American worker on the crew, testified that the foreman belittled him for being "cool" with the "white mother fuckers" who were his coworkers. He allegedly called Thompson an "F'ing Uncle Tom" and "whitewash." He also allegedly called Thompson a "nigger." In fact, the evidence suggested he did so frequently. The foreman likewise called Thompson's Latino coworkers "mother fucking wetbacks," and did so "all the time." By the same token, he referred to Plaintiff Vitaliy Ostapyuk, a Caucasian born in Ukraine, as a "fing Russian."
