The Fact Scenario

A person consumed large amounts of alcohol and drugs. He consumed these drugs and alcohol voluntarily. He does not remember doing this, but apparently he really badly beat up someone while really drunk and under the influence of drugs, and has been charged with the crime of assault causing bodily harm.

The lawyer you work for has asked to you do research on how section 33.1 of the Criminal Code of Canada ('Self-induced intoxication') applies to this fact scenario (this will require that you consider how courts have interpreted or applied this section of the Criminal Code). The lawyer you work for also wants you to do research to determine (through explanations given in the case law and in secondary sources, like journal articles) why this limitation on a defence to the criminal charge exists, why do some support the existence of this section, and what are some of the criticisms against this section existing.
