The Federal Government, in the wake of the Supreme Court of Canada's decision Greenhouse Gas Pollution Pricing Act, 2021 SCC 11 (edited version attached) (no other research is required or expected), has enacted "Fighting Climate Change: An Act to Assess the Environmental Impact of Designated Development Projects" ("FCC Act"). The stated purpose of the FCC Act is to protect the environment where a development project is "financed by the federal government" or "will have any adverse effects on the environment within federal jurisdiction." To achieve its purpose, the FCC Act, where a project becomes "designated" for either of the two criteria ("financing by the federal government" or "adverse effect" requires the following: 1. An environmental assessment conducted by the Federal Environmental Assessment Agency in which the Agency: 1. Gathers information from the proponent (usually a private land development company) of the designated project; 2. Consults with stakeholders potentially impacted by designated project, including First Nations and Indigenous Peoples; 3. Prepares an "Assessment Report" in which the Agency identifies the likely effects of the designated project that are adverse within federal jurisdiction including environmental, health and economic effects. 2.
