The following is an actual case. Dawn, a veteran trainer of Orca Whales was killed while working with Tilikum at Sea World. Orca's are commonly known as "killer whales" and Tilikum had previously been involved in two other incidents that caused the deaths of people, including a Canadian trainer in 1991. Dawn was familiar with Tilikum's past history. Dawn was working alone with Tilikum from a poolside platform when he grabbed her ponytail and pulled her in the water. She died of drowning and internal injuries. Dawn's relatives have brought a tort suit against Sea World. The suit claims that Sea World is liable for Dawn's death. Sea World claims they are not liable, setting forth several defenses to support their argument. 1.
