The high cost of litigation is held by some to make a positive contribution to the policy of keeping down the volume of litigation. High cost, it is believed, discourages unmeritorious claims, encourages litigants to settle, and promotes the search for Alternative Dispute Resolution methods, thus keeping many disputes out of the court system.
