The judicial branch may act as a tool for social change, that is, changing the policies that create disparities. Different from the legislative and executive branches, some scholars may identify the judicial branch as a "passive" change agent, meaning that courts do not initiate the social change. Rather, courts wait for a plaintiff to file a complaint with a trial court. The court's adjudication of that case, and subsequent appeals of the court's decision, may change policies that create disparities. To that end, one complaint may be the first step toward social change.

Businesses themselves are becoming greater drivers of social change, using the legal system to support their stance. Students were introduced to plaintiffs, Bongo Productions, LLC and others, and the complaint they filed on June 25, 2021 against defendants, Carter Lawrence and others, in the United States District Court for the Middle District of Tennessee.
