The Legal and Ethical Environment of Management- Case Study: Agency Stefon Diggs, a 19-year-old college student, is an employee of Al's Burger Heaven, a locally owned fast food restaurant in Rochester, Minnesota. While he is working one Tuesday afternoon, the owner of the business, Mike Zimmer, asked him to go to run to the bank and get some additional small bills. A large number of customers had paid with large bills that day and the business was running low on ones and fives. Zimmer gave Diggs three one hundred dollar bills and asked him to bring back "a bunch of ones and fives, and a few tens." He then tells Diggs, "you can drive your own car and I will give you a couple bucks for gas." The bank is a 10- minute drive across town.~ Diggs jumped into his 2014 Dodge Ram and headed off for the bank. A block or so from Burger Heaven, Diggs decided to stop at the local mall on the way. His friend, Adam Thielen, worked as a security guard at the Target retail store in the mall and Diggs figured he would stop and see Thielen and then grab a taco for lunch with him at the Taco Bell store in the mall. As he drove up to the Target entrance to the mall, Diggs saw Thielen chase a man dressed in black. Thielen spotted Diggs and yelled, "follow him, he just shoplifted at the store."- Diggs stepped on the gas and followed the shoplifter into the parking ramp attached to the mall. In the process, he crashed into the fender of a Lexus parked inside the mall. I.M. Rich, the owner of the car, was inside the car at the time of the collision. After the collision, Diggs jumped out and pursued the shoplifter up the ramp. Seeing Diggs approaching quickly, the bandit jumped up on the wall of the ramp, but then lost his balance, and unfortunately fell to the floor below landing heavily on the cement. As a result of the fall, he broke his leg, fractured a rib and suffered a severe concussion. A bag of shoplifted clothes is discovered at his side.~ After the shoplifter is successfully prosecuted, he sued Target Corporation for his injuries, alleging that Diggs was acting as an agent of the Target Corporation and that his aggressive and unreasonable pursuit frightened him and caused him to fall and injure himself. In addition, I.M. Rich, the owner of the Lexus that Diggs crashed into, suffered a back injury as a result of the accident. He sued Target Corporation and Al's Burger Heaven for damages, alleging that Diggs was acting as an agent for both at the time of the collision. Target Corporation and Al's both deny responsibility noting that Diggs was not acting as an agent for either party at the time of the incident. Write a memo discussing the legal implications to this case. Consider whether Diggs served as an agent for one or both of the businesses at the time of the incident. Also consider whether Diggs or Thielen would be individually liable for the injuries to these parties.~
