general allegations:
that on August 4, 2016 at approximately 7:45 AM the plaintiff Catherine Baranski was exercising reasonable care and driving her car in a southbound direction on Mathis Avenue when a vehicle driven by the defendant Tony Peretto collided with the plaintiffs vehicle. the collision occurred as defendant Peretto attempted to drive his vehicle across Madison Avenue on 38th St. that the defendant Tony Peretto Owed the plaintiff Catherine Baranski the following duties of care;
A. duty to stop at the stop sign on 38th St. before crossing Madison Avenue.
B.duty to make reasonable observations of vehicles in Plainview before crossing Madison Avenue
C. duty now to drive his motor vehicle in a reckless careless or heedless manner with willful and wanton disregard for the safety rights of others within the meaning of section 92326(2) of the Nita statutes annotated
that the defendant Tony Peretto breached each of the above duties and violated the following statues of the state of Nica that he was guilty of reckless driving within the meaning of section 9.2326(2)of the Nica statutes annotated that he was guilty of;
careless and negligent driving within the meaning of section 9.2326(20
of the Nita statutes annotated
that at the time of the collision the weather conditions were clear and it was daylight
