The legal issues in this case are really on a state level. While there are federal require-ments to have an HIV policy in place for the hospital, the laws of testing and exposure proce-dures vary from state to state. Since I am in the state of Florida, I will use Florida laws as aguideline. HIV Law and Policy's website for Florida law does not cite mandatory testing forhealthcare professionals. It is, however, encouraged. So, Dr. Marshall did not have to inform thehospital of his HIV status, nor would he be required to notify the patient. However, upon review-ing the FloridaSOURCEBOOK ON STATE AND FEDERAL HIV CRIMINAL LAW AND PRAC-TICEthere are numerous cases where HIV carriers were prosecuted and convicted of anythingfrom attempted murder to negligence. So, it can be easily presumed that, should the patient findout or become HIV positive, a lawsuit could be made against Dr. Marshall or the hospital. If asexual partner can be prosecuted for failure to notify their partner, so then could Dr. Marshall beprosecuted for failure to inform. If he had notified the hospital of his HIV status, he could, atleast carry the protection from them that there is no requirement for testing or patient notif-ication.
