The Miranda Rights are spoken at the time of every arrest, and it is a requirement for all officers. Yet, some of the arrestees are under the influence of drugs, alcohol, or other lunacy. Do you think that the cognitive mind can appropriately consent to accepting to know their rights under those provisions? Also, referring back to dying declaration, "dying declaration A statement by a person who is conscious and reasonably believes that death is imminent concerning what he or she believes to be the cause or circumstances of death that can be introduced into evidence during a trial in certain cases," (Birzer & Roberson, 2015). How can one undergoing the feeling of death have such a clear mind that they accept dying declarations? Limited cases, of course, but interesting to think of someone's capability of an important message so close to death.
