The Mitchell's from Washington State, purchased a used Smart Car Proxy Coupe with the Brabus sport package from a seller in California after viewing photo's and settling on a price on eBay. The sellers' statements on eBay claimed that "everything works fine on this vehicle and that the mileage is accurate." The Mitchell's picked up the Smart Car in California, but on the drive back to Washington, the car overheated and caught on fire. The Mitchell's have decided to sue the seller.
