The purpose of this assignment is to assess the understanding of the students on the application of the law of contract regarding sale and purchase of real property in Malaysia.The transaction is usually conducted between a buyer and a housing developer or an individual seller. There are a lot of arising issues, in particular defects on the property, delay in the delivery of possession of the property, and insufficient documentation for the purpose of transfer of title; and parties either end up in the Tribunal for Homebuyer Claims or Courts. Students are required to look into the issues, evaluate them and recommend better solutions to the parties.
Requirements:
1.Students have to discuss the issues regarding defects on the property, delay in the delivery of possession and insufficient documentation for the purpose of transfer of title, identify relevant principles from the Contracts Act 1950 and apply the relevant principles to the issues, supported by examples and cases.
2.Students are also encouraged to refer to the Housing Development (Control and Licensing) Act 1966.
3.Students are expected to provide their recommendations and conclusion based on the discussion.
