The question is based on the South African Law of Damages

Question 1

Mr B bought a lounge suite for R50 000 from CDE Furniture Stores and paid for it in full. However, when the truck was on its way to deliver the furniture to Mr B's place of residence, it was involved in an accident. As a result of this accident the furniture was irreparably damaged. Does Mr B have any remedy that he can use to recover the costs? If so, how much will be able to recover?

Question 2

Use the same set of facts as in Question 1 above, but this time assume that Mr B's lounge suite was delivered. However, after it was delivered Mr B discovered that there were defects in the lounge suite delivered to him that CDE Furniture Stores did not disclose. Some of the cushions had broken zippers and the colour of the fabric differed on some chairs. Which remedy would Mr B have in this case against CDE Furniture Stores?
