The requirement for the State to present evidence in support of a criminal indictment is a major part of the U.S. Justice System that flows from the 4th Amendment's protections against unreasonable search and seizures. Garrett and Mitchell (2023) highlight an interesting debate around the idea put forth by William Blackstone that it is a worse thing for an innocent man to be convicted than for a guilty man to go free.
