The ground of attack of public policy is likely to be far much more successful. From the perspective of the 195Us this type of covenant may have been perfectly acceptable to the vast majority of Canadians, however in light of the public policy of the 21st century it is reprehensible. 'What is important to the argument is that the public policy at the time of the attack is the critical aspect, not at the point of creation of the restrictive covenant.
