The State of California requires that employers who provide health care benefits for its employees also provide coverage for birth control. ERISA does not require coverage for birth control. ABC, Inc. wishes to open a branch in California but does not wish to provide birth control coverage because of its cost (not because of religious reasons) and wishes to argue that ERISA doesn't require it and thus the California law is preempted. Is it preempted?
