Max's parents, enraged at the law, file a lawsuit against the state of New York, claiming that the transgender bathroom law violates the U.S. Constitution in that it is discriminatory. 1) Based on your readings, what is the state of New York's best defense against this lawsuit? 2) What would YOU recommend to Max's family to make the lawsuit stronger? Based off of the readings New York's best defense would be that there is people at risk for letting transgenders into the bathroom they identify with. The other women in the bathroom may feel uncomfortable or may be unsafe. Other people may use the restrooms and claim to be transgender for their own agendas that may be dangerous. 2- Max's family's best defense would be to argue that there has been discrimination against Max and others in the LGBTQ+ community. They could also add more incidents that he has been discriminated against by the state. They should also show that there have been no reports of assault or anyone in danger from a transgender using the bathroom from which they identify with
