The State of Transylvania Abortion Control Act ("TACA") provides that: (a) a woman seeking an abortion must give her informed consent prior to the abortion procedure, and specifies that she will be provided with certain informationat least 24hours before the abortion is performed; (b) for an unmarried minor to obtain an abortion,the Act requires the informed consent of one of her parents; and (c) a married woman seeking an abortion must sign a statement indicating that shehas notified her husband of her intended abortion. The Act further imposes certain reporting requirements on facilities that provide abortion services.

A challenge by an unmarried minor, byand through a personas next friend,to the constitutionality of TACA will:

1. Fail, because a State has a compelling interest in protecting the health and welfare of children within its borders and its action is necessary to achieve this purpose.

2. Succeed, because the State's reason for this provision cannot be said to be substantially related to an important government purpose.

3. Fail, because a minor lacks standing to file suit unless such suit is brought by a parent or legal guardian.

4. Succeed, because TACA fails to provide for a judicial bypass option in the event the minor does not wish to or cannot obtain a parent's consent.
