The Supreme Court considered whether agencies could opt out of the nondiscrimination requirement when determining foster parent eligibility in Fulton vs. the City of Philadelphia (see Washington Post: The history behind the latest LGBTQ rights case at the Supreme Court). In 2016, the last state legislation preventing LBGTQ+ couples from becoming foster parents were struck down, however this court case allowed state agencies to discriminate in foster care eligibility.
