The Supreme Court has held that the death penalty is constitutional. There are, however, several cases on the docket that challenge whether it should continue to be constitutional. I pose a question: are there sufficient procedural protections to ensure that the death penalty is administered in accordance with due process? Consider mental illness, the recent school shooting, the alternative (supermax with 23 hour per day solitary confinement) and other practical issues (as opposed to theological or personal philosophies).
