The U.S. Supreme court case Kyllo vs. United States was a significant 4th amendment decision concerning the use of thermal imaging technology by law enforcement. The case was based around thermal images of Kyllo's house showing he was growing marijuana. COURT HOLDING: In a 5-4 decision the Supreme Court held that " The use of thermal imaging technology to monitor heat emissions of Yellow's home constituted a search under the 4th amendment and therefore required a warrant ( Oyez,2001)". I agree with the decision in the Kyllo vs United States case. A persons home is supposed to be there safe place and because of that is protected under the 4th amendment rights, anything that could violate that whether it be thermal imaging, drone footage, wire taps, etc should not be allowed as admissible or proof beyond a doubt. I also agree with the decision because realistically thermal imaging isn't always accurate, and on numerous occasions can or has given false results. Thermal imaging devices can not distinguish between different heat sources, and do not give details in regards to the sources this can lead to bias opinions and can be considered subjective when law enforcement review them. Highly reflective objects such as mirrors, glass, linoleum floors, stainless Steele appliances interfere with thermal imaging. " These surfaces may reflect ambient heat which leads to in accurate readings ( Fire Apparatus Magazine, 2023 )
