exceeding 60,000 tonnes.
Laytime for loading shall be calculated and decided upon prior to the commencement of cargo operations by means of the standard formula applicable in such circumstances.
Laytime for discharging shall be calculated as per the customary practice for discharge operations.
The vessel is to load at a rate of 9,600 tonnes per weather working day.
Dalian, Sundays and holidays excepted unless worked.
Dalian, Demurrage at $15,000 per day and pro rata; despatch at $8,000 per
day and pro rata.
Wellington, Demurrage at $12,000 per day and pro rata; despatch is as per
custom.
Laytime is irreversible.
The vessel is to discharge at a rate of 14,150 tonnes per day.
Wellington, Saturday, Sunday and holiday excepted. Loading costs are $8 per tonne; discharge costs are $10 per tonne. A C/P clause reads that, “If and whenever the ship-owner is responsible for load and discharge costs, the charterer is to make a contribution of 50 cents per tonne towards stevedoring costs”.
Charterer (receiver) has the option of deducting 1% in lieu of weighting.
Deadfreight, if any, to be paid at $100 per tonne.
Freight is at $200 per tonne.
The relevant facts at DALIAN were:
“East Red”, when within the limits of the Port of Dalian, anchored at 08.46 hours on Wednesday 14th September. The master issued a N.O.R. claiming that it required not less than 11 hours to clean the holds and so stated the N.O.R would be effective at 20.00 hours that evening. The Master called for 57,600 tonnes to be loaded.
It rained from 03.01 hours to 20.01 hours on 15th September and the Master made a presumption as to why the stevedores had not commenced loading the ship. However, by 20.52 hours with the rain having stopped, but loading not having commenced the Master thought it prudent to issue a further N.O.R timed 21:00 hours on 15th September, confirming that the vessel was ready in all aspects and called for 57,600 tonnes to be loaded.
The vessel berthed at 03:00 hours on 16th September, at which time (i.e. 03:00 hours) loading commenced.

21st September, 00.01 to 23.59 hours,
27th September, 00.01 to 23.59 hours.
Labour was not available;
From 00.01 hours on 19th until 23.59 hours on 20th September.
From 00.01 hours on 24th until 23.59 hours on 25th September.
Cargo operations were completed at 9.00 hours on 28th September at which time “East Red” promptly sailed from Dalian for Wellington. The Bill of Lading (B/L) contained the statement, “56,600 tonnes of grain received on board in apparent good order and condition”.
The relevant facts at Wellington were:
“East Red” berthed at Aotea Wharf in Wellington and rang F.W.E. at 05.00
hours on Wednesday 12th October.
The charterer (receiver) promptly declared her option not to weigh the cargo.
Discharge commenced at 06.00 hours on 12th October.
Public Holidays were as follows;
14th October, “Long White Shroud Day”
17th October, St. Aeolis Day
Rain prevented cargo from being worked;
16th October, 00.01 to 23.59.
Labour was not available;
17th October, 00.01 to 23.59 hours due to a Rugby Match.
19th October, 00.01 to 23.59 hours.
At 06.00 hours on 20th October, “East Red” completed cargo operations, was placed at the disposal of her owners, and promptly departed Wellington for her next charter.

a) The times “00.01” and “23.59” are only used to identify the day. In any calculation, the times “00.00” and “24.00” should be used in place of these “identification” times.
b) All times are Local Mean Time (L.M.T).
c) Once cargo operations in Dalian and Wellington have initially commenced, you should assume that cargo is worked 24 hours per day unless you are advised otherwise.
d) Office hours in Dalian and Wellington are “24 hours per day, 365 days per year”.
e) All currency is in US Dollars (i.e. dollars and where appropriate cents).
