The WTO Agreement on Technical Barriers to Trade (TBT Agreement) is one of the 1994 Uruguay Round agreements which governs the use of technical regulations, product standards, testing, and certifications by WTO member countries. One problem that crops up from time to time with the TBT Agreement is when a country attempts to use its regulations or standards as a guise to discriminate against the import of foreign goods. Read the Report of Appellate Body WT/DS406/AB/R (2012) World Trade Organization on page 266 of your textbook. This case involved the measures enacted by the United States which affected the production and sale of clove cigarettes. The U.S. claimed its actions were for the purpose of protecting its youth from the dangers of cigarette smoking. Indonesia cried "foul" and claimed it was a thinly disguised effort to unlawfully ban flavored tobacco products made in other countries.
