There are two parties one wapda 2 vendor who have signed an agreement regarding the supply of high volt electric wires and the total consideration of the supply is 100 Million rupees and said agreement included an arbitration clause. in a mean while before the work orders the rate of wires suddenly went high, which may cause loss to the vendor. the vendor after the delivery of the wires applied to the department for escalation of the amount. Wapda refuced and the vendor filed a suit before the Civil Court. whether the vendor can file a civil suit in the presence of above stated agreement . explain your answer with reasons. and in the above situation what would be legal remedy available with the wapda against whom a case has been filed to refer the matter to arbitrator on first date of appearance
